Terms and conditions of sale
1.1. These general terms and conditions of sale (hereinafter: "General Terms and Conditions") apply to any purchase of products or services made on the atelierm12.ch website (hereinafter: "the Site"), operated by atelier M12 - Michaël Martins (hereinafter: " atelier M12 "), Route de Grallard 15b, 1867 Ollon, Switzerland.
1.2. Online offers of products and services are valid as long as they are visible on the Site and within the limit of available stocks of materials. Product images on the Site are provided for illustrative purposes only and are not contractually binding. Information in catalogs and leaflets is given for information only and does not constitute a contractual commitment.
1.3. atelier M12 reserves the right to modify these terms and conditions at any time. The version in force at the time of the order is applicable.
2.1. The products and prices published on the site constitute an offer. However, this offer is subject to the condition that the raw material is available and that the prices do not contain any errors.
2.2. The contract is concluded as soon as the customer places an order and atelier M12 sends an order confirmation e-mail. This e-mail confirms receipt of the order, but does not guarantee immediate availability or delivery of the products.
2.3. atelier M12 reserves the right to refuse an order for legitimate reasons, in particular in the event of non-compliance with these conditions or suspicion of fraud.
2.4. In the event of a significant price increase for materials after the order has been placed, but before the order confirmation has been sent, atelier M12 reserves the right to inform the customer of this change. If the customer does not accept the new price, he may cancel the order free of charge, and any amount already paid will be refunded in full.
3.1. Prices are quoted in Swiss francs (CHF) and include VAT and advance recycling tax (ARR). Shipping and handling costs are extra and are indicated separately during the order process.
3.2 atelier M12 accepts payment via MasterCard, Visa, Twint and bank transfer. All transactions are secured via a payment platform.
3.3. The price invoiced is that indicated in the order confirmation. The credit card is charged at the time of the order.
3.4. For payments by bank transfer, the order is validated only after full payment has been received in theatelier M12 bank account.
3.5. In the event of cancellation of an order by the customer after it has been confirmed, all costs already incurred by atelier M12 for the manufacture, personalization or preparation of the order are payable by the customer. These costs include the cost of materials, labor and any other expenses incurred in processing the order up to the time of cancellation. The amount due will be calculated and communicated to the customer as soon as possible.
4.1. The delivery times indicated are estimates and begin with the order confirmation. atelier M12 will provide you with an estimate of the delivery time at the time of this confirmation. The exact delivery date will be communicated to you a few days before dispatch. atelier M12 endeavours to meet estimated delivery times, but accepts no liability for delays due to unforeseen circumstances or third parties.
4.2. If several products are ordered with different delivery times, atelier M12 may combine delivery, unless the customer requests otherwise.
4.3. The customer must check the products on receipt and report any defects or non-conformities to atelier M12 within 7 days.
4.4. Delivery charges are calculated as a flat rate according to the weight of the item and are invoiced in addition.
4.5. For bulky items or items exceeding a certain weight requiring the use of a carrier, a rate is established according to the weight of the item and the distance to be covered, calculated in kilometers from the production site.
4.6 The customer may also collect the item directly from the production site. In this case, the article is handed over to the customer against signature, before loading. atelier M12 cannot be held responsible for damage occurring after the article has been handed over and signed for by the customer.
4.7 The assembly service included in the delivery package covers only the assembly of the furniture. Wall mounting is excluded from this service. If the customer requires wall mounting, a suitable solution can be proposed on request.
4.8 The evacuation service included in the delivery package is limited to the protection used for the transport and delivery of your order. Evacuation of old furniture is not included, but we can propose a suitable solution on request.
5.1. All items sold by atelier M12 are made to order or customized to the customer's specifications. Due to the unique nature of these products, they cannot be returned or exchanged, except in the case of a proven defect or non-conformity with the order.
5.2 In the event of a return concerning a proven defect or non-conformity with the order, items must be returned in their original condition, unused and in their original packaging. atelier M12 will cover the cost of return, subject to confirmation of the defect or non-conformity by our after-sales service.
5.3. Any claim concerning a defective product must be made by e-mail to info@atelierm12.ch. In the event of returned goods, reimbursement will be made according to the method of payment used at the time of purchase, after verification of the product.
6.1. atelier M12 offers a 12-year warranty on all products from the date of delivery.
What does the warranty not cover?
Normal wear and tear: cut marks, scratches or damage caused by improper use, accident or shock. Damage and discoloration caused by lack of maintenance or maintenance that does not comply with our recommendations. Products that have been improperly stored, assembled or used, modified or exposed to unsuitable conditions, such as severe temperature variations, direct sunlight or unsuitable environments (e.g. outdoors, bathroom). In the case of replacement products obtained under warranty, the warranty expires on receipt of the new product. However, the new product remains covered by the general right of complaint in accordance with the law on sales.
As wood is a natural material, variations in color, texture and grain, as well as the presence of knots or small cracks, are inherent to the material and do not constitute a defect. Small cracks or slight deformations in the wood are completely normal: they result from the natural drying process of the wood, which continues once the furniture has been installed in your home. What's more, wood is a hygroscopic material, meaning it reacts to moisture in its environment. It is essential to maintain wooden furniture in an environment with an appropriate humidity level (ideally between 40% and 60%) to avoid any risk of warping or excessive cracking. atelier M12 cannot be held responsible for any damage caused by an unsuitable environment.
Stone, marble and the like are natural materials, quarried in large blocks and then cut into smaller pieces to be shaped into furniture. Each platter is unique, with variations in hue and pattern that add to its charm. This distinctive character is not a defect, but a quality that makes each piece unique, in your image. Prior to delivery, we carefully inspect each piece of furniture to ensure that it meets our high standards of quality and stability.
Pilling on textiles is completely normal. This natural phenomenon results from friction and is similar to that seen on a sweater. It occurs mainly at the start of use, as excess fibers loosen.
6.2. In the event of a proven defect, atelier M12 reserves the right to repair or replace the product. Repair or replacement does not extend the warranty period.
Failure by the customer to comply with any of its obligations, in particular payment, may result in the immediate payment of sums due and the suspension or cancellation of orders in progress.
8.1. This contract is governed by Swiss law.
8.2. In the event of a dispute, the competent courts will be those of the canton of Vaud, headquarters of atelier M12.
9.1. The atelierm12.ch website and all its contents (designs, images, texts, videos, etc.) are the exclusive property ofatelier M12 or its partners. Any unauthorized use of these contents is prohibited without the prior written consent of atelier M12.
